1. Acceptance of Terms

By accessing or using the El Pirata website at https://elpiratapr.com or the interactive experience El Pirata: The Governor’s Lie, you agree to these Terms of Service. If you do not agree, do not use the services.

2. The Experience

El Pirata: The Governor’s Lie is a self-guided outdoor mystery and scavenger-hunt experience through public areas of Old San Juan, Puerto Rico. It leads you to real public landmarks and uses their genuine history alongside a fictional story.

The six landmarks are real places. The characters, dialogue, mystery, witness testimonies, and story elements are fictional and created for entertainment.

3. Eligibility

You must be able to enter a binding transaction to purchase access. A parent or guardian is responsible for any minor participating in the experience and for supervising that minor’s use of the services.

4. Purchases and Payments

Purchases are processed through Stripe. The prices displayed at checkout apply to your purchase and may change for future purchases. A crew pass is intended for one participating crew playing together on one smartphone, unless a different offer is explicitly presented at checkout.

5. Your Equipment

You are responsible for providing a compatible, charged smartphone and an active internet connection. El Pirata is not responsible for access issues caused by your device, network, or connectivity.

6. Refunds

Refund requests are reviewed case by case. If you experience a technical problem, please contact support promptly. Nothing in these terms limits any non-waivable consumer rights you may have under applicable law.

7. Self-Guided Experience

The experience is self-guided. It does not include a staffed guide, a supervised route, guaranteed access to any attraction, or a staffed meeting point.

8. Outdoor and Personal Safety

You participate in public areas and are responsible for your own safety. You must remain aware of traffic, vehicles, pedestrians, uneven streets and cobblestones, stairs, weather, construction, closures, and surrounding conditions. You must follow laws, signs, property restrictions, and instructions from local authorities. Stop participating whenever conditions appear unsafe. El Pirata does not provide emergency services.

9. Route and Landmark Availability

Route or landmark availability may change because of closures, construction, weather, public events, connectivity, or other circumstances outside El Pirata’s control.

10. Intellectual Property

El Pirata owns the intellectual property in the experience, including its story, characters, artwork, and content. We grant you a limited, personal, noncommercial license to use the experience for your own participation.

11. Prohibited Conduct

You may not:

• Copy, resell, or publicly distribute protected game content.
• Scrape or reverse engineer the experience.
• Share credentials or access beyond your crew.
• Publish protected game content, solutions, or endings.

12. No Uninterrupted Service

We do not guarantee that the service will always be uninterrupted or error-free. The experience is provided on an “as available” basis.

13. Disclaimers and Limitation of Liability

To the extent permitted by applicable law, the services are provided “as is” and “as available,” without warranties of any kind. To the extent permitted by applicable law, El Pirata’s liability for any claim arising from the services is limited to the amount you paid for the experience. Nothing in these terms attempts to waive liability that cannot legally be waived under applicable law.

14. Third-Party Services

The services include or link to third-party services, including Stripe. We are not responsible for the practices or availability of third-party services.

15. Suspension or Termination

We may suspend or terminate access for misuse, prohibited conduct, or violation of these terms.

16. Changes to the Service or Terms

We may change or discontinue features of the service, and we may update these terms. Continued use after a change means you accept the updated terms.

17. Severability and Entire Agreement

If any part of these terms is found unenforceable, the remaining parts remain in effect. These terms constitute the entire agreement between you and El Pirata regarding the services.
